Arizona is considered an “at-will” employment state, meaning that an employer may terminate an employee at any time. Basically, an employer/employee relationship is treated like a contract that can be terminated by either side at any time.
However, as an employee you are also protected by Arizona and federal laws that prohibit you from being discriminated against based on race, religion, sex, age, national origin or disability. The only exception is that some employers with less than 15 employees may be exempt from some discrimination laws. An employee cannot also be discriminated against if they are pregnant, take advantage of family medical leave or who have veteran status. Laws also exist to protect employees when they engage in “protected activities” such as participating in an investigation of alleged discrimination, or if they attempt to assert their own legally protected rights. Whistleblowers are also protected against retaliation if they report misconduct by an employer.
Phoenix and Tucson have also passed local laws that prohibit discrimination on the basis of sexual orientation, gender identity or marital status.
If you are the victim of a wrongful termination for any of these reasons, you need to seek out an experienced wrongful termination attorney. At The Wilmer Law Firm, we have been protecting the rights of employees who have been terminated in violation of local, state and federal laws for many years. If you are fired in violation of any of these laws, you have the recourse to sue for wrongful termination within one year after you have been let go.
Wrongful termination cases can be complex and must meet certain standards for a suit to be successful. As an employee, you may also be going up against considerable legal representation by your employer, so you should not shortchange yourself when it comes to hiring your own discrimination or wrongful termination lawyer.
